Article 15 of the Constitution gives foreigners and stateless persons present or resident in Portugal in principle the same rights and duties as citizens, with exceptions for political rights, public office and rights reserved to Portuguese citizens. A tax number (NIF) is needed to transact, and a fiscal representative resident in Portugal is mandatory for taxpayers resident outside the EU and EEA, and optional for those resident in the EU or EEA (General Tax Law article 19).

Residence through property

Residence permit for investment (golden visa), real estate routes

Threshold
  • Law 56/2023 (published 6 October 2023, in force the next day, 7 October 2023) bars new applications under the real estate sub paragraphs i), iii) and iv) of article 3 n.
  • 1 d) of Law 23/2007, and after the reform the remaining investment activities may not be directed, directly or indirectly, to real estate (article 90 A, as amended).
  • Renewals of permits already granted, applications pending on 7 October 2023 and related family reunification remain possible; renewed permits convert into the entrepreneur immigrant permit with minimum stays of 7 days in the first year and 14 days in each later two year period.
Status

Residence permit for investment, routes that remain

Threshold

Law 56/2023 text read shows two remaining capital routes: at least EUR 500,000 to acquire units of non real estate collective investment undertakings set up under Portuguese law with at least five years maturity and at least 60% invested in companies based in Portugal; and at least EUR 500,000 to set up a company with five permanent jobs, or to reinforce a company with five new or ten kept jobs (at least five permanent) for at least three years. Amounts may be 20% lower in low density territories for some routes.

Status

open

Non Habitual Resident regime (NHR), closed to new entrants, and IFICI replacement

Threshold
  • The NHR regime was repealed from 2024.
  • Law 82/2023 article 236 protects taxpayers already registered, and those who became resident by 31 December 2024 holding listed evidence (such as a lease or promise to buy signed by 10 October 2023, a work contract signed by 31 December 2023 or a visa application started by 31 December 2023).
  • The replacement IFICI (article 58 A of the Tax Benefits Statute) taxes net category A and B income from eligible research, innovation and highly qualified activities at 20% for 10 consecutive years, requires not being resident in the previous five years, and does not depend on property ownership.
  • Foreign income of listed categories is generally exempt, with 35% on income paid from listed low tax jurisdictions.
Status

Threshold

Consular information pages state that means of subsistence must be a constant, stable flow at least equal to the Portuguese minimum wage (EUR 920 in 2026), from movable or immovable property, intellectual property or financial investments, with housing proof for at least one year. The embassy page states the D7 cannot be used by someone working remotely for companies outside Portugal.

Status

Threshold

Decree Law 76/2024 (in force 1 November 2024) removed the suspension of new local accommodation registrations in apartments, the five year validity of registrations and the general condominium authorisation requirement, and lets municipalities set contention areas by parish where new registrations can be barred; municipalities have 60 days to oppose a new registration (90 days in contention areas); a condominium assembly may oppose a fraction by a reasoned resolution of more than half of the building's permilagem after proven repeated disturbance, and may bar the activity for future requests by two thirds.

The usual steps, in order

  1. Obtain a Portuguese tax number (NIF); a fiscal representative is needed if the buyer lives outside the EU and EEA.
  2. Sign a promissory contract (contrato promessa) and pay a deposit, after checking title, charges and the building licence at the land registry and the municipality.
  3. Pay IMT and stamp duty on the day of assessment or within the following 30 days, before the deed.
  4. Execute the deed (escritura) before a notary or the one stop service, with proof of tax paid, then register the transfer with the land registry.
  5. Declare the property to the tax authority so that the municipal property tax (IMI) bill is issued to the owner.
  6. A non resident owner files the annual income tax return for rent or gains; a non resident buyer who becomes tax resident within two years, or lets the home at moderate rent, can request a refund of the difference to the ordinary IMT scale within six months.
  7. For short stay letting, the registration with the municipality follows the local accommodation regime (Decree Law 76/2024), and the municipality can oppose it or bar it in a contention area.

What is changing

  • Decree Law 97/2026 brought the investment contract regime, the housing rent regime and the repeal of Decree Laws 68/2019 and 69/2019 into effect on 1 September 2026.
  • The 10 percent autonomous rate on housing rent not above the moderate rent cap applies to income earned up to 31 December 2029 under Decree Law 97/2026.
  • The relief for gains reinvested in housing let at moderate rent applies to sales between 1 January 2026 and 31 December 2029 under Decree Law 97/2026.

Questions people ask

What if I am not a tax resident and buy a flat in Portugal?

Buying is open, but IMT on housing is a flat 7.5% for a buyer who is not tax resident, without the usual exemptions or reductions. If the buyer becomes tax resident within two years, or lets the home at moderate rent for at least 36 months in the first five years, the ordinary scale applies on request.

What if I was relying on the Golden Visa for a property purchase?

Since 7 October 2023 new residence permit applications based on real estate investment are not accepted. Permits already granted can be renewed and applications pending on that date were kept. The routes that remain involve fund units, companies and similar activities that cannot be directed to real estate.

How does rent tax work for a non resident landlord?

Housing rent is taxed at 25% and other rent at 28%, with cuts for long leases, and a 10% rate for moderate rent leases until 2029. Residents of other EU or EEA states can opt for the progressive scale on some rental items. A fiscal representative is needed if the landlord lives outside the EU and EEA.

What if I want to use a property for Alojamento Local (short stay lets)?

Registration is with the municipality under Decree Law 128/2014 as republished by Decree Law 76/2024 (in force 1 November 2024). Municipalities can create containment areas, limit new registrations, bar new registrations in homes let for housing in the previous two years, and limit transfer of new registrations. Condominiums can ban the use for the future by a two thirds vote by permilage.

How does the yearly property tax work for IMI and AIMI?

IMI is 0.3% to 0.45% of tax value for urban property (0.8% rustic), set by the municipality. AIMI applies to high value residential and land: 0.7% to 1.5% for individuals above EUR 600,000 (EUR 1.2 million for couples filing jointly), 0.4% for companies, and 7.5% for entities in listed low tax regimes.

What if a non resident inherits a Portuguese property?

There is no inheritance tax as such, but stamp duty of 10% applies to the value of a gratuitous acquisition of Portuguese assets, plus 0.8% on real estate. Spouse or partner, descendants and ascendants are exempt from the 10% charge.

What if I sell a Portuguese property as a non resident?

Since 2023 the gain is counted in the progressive scale at 50% of its value, with other income used only to find the rate; the former flat 28% on property gains was revoked. A gain on the owner's own permanent home can be excluded if the proceeds are reinvested in another home in Portugal or another EU or EEA state within the set period.

What if the 7.5% IMT start date matters for a purchase near the end of May 2026?

Decree Law 97/2026 was published on 20 May 2026 and fixes no separate start date for the 7.5% IMT on non resident buyers; under the rule for diplomas that fix no day, it entered into force on the fifth day after publication, 25 May 2026. The 1 September 2026 date in the decree applies to other parts (the investment contract regime, the housing rent regime and the repeal of two decree laws).

What if a non resident wants the D7 or D8 visa?

Consular pages state that the D7 needs stable means at least equal to the Portuguese minimum wage (EUR 920 in 2026) and the D8 needs four times that amount with proof of tax residence. Owning property is not a criterion of either visa.
